Last night, Black Door Law Associate, Scott Balloch, joined Wallace Chapman on Radio New Zealand’s, The Panel, to discuss the Government’s proposal to prevent contractors from challenging their employment status through the Courts. Given the rise of the ‘gig economy’ and changes to the way that we work (the use of technology and remote-working), perhaps it is time for Parliament to review the current framework. In the meanwhile, we will eagerly await the Court of Appeal’s decision on the employee/contractor decision in the Uber case. While I do think they should have disclosed their relationship and that it's probably best to recuse themselves, the outrageous questions about whether Wade "visited you where you laid your head" was insulting and meant to humiliate her. The questions were blatant attacks that are often used to undermine the credibility and professionalism of Black women even when their non-Black counterparts engage in similar behavior without repercussion. Unfortunately these unfair attacks often revolve around three strategies:1. Attempts to paint us as incompetent and under qualified "Diversity hires" or beneficiaries of Affirmative Action despite any evidence to the contrary.2. Attempt to paint us as overly aggressive/loud/angry, despite similar personality traits of non-Black professional women, and also at times despite provocation.3. Morally unworthy, hypersexual and promiscuous. Often even the mere act of sharing the same physical space with a male colleague is conflated to not only "prove" the existence of an inappropriate sexual relationship, but in some cases it is also used as malicious, retaliatory justification by other males in the workplace to subject Black women to harassment and/or retaliation for not being interested in their sexual advances.Shameful!https://lnkd.in/g_mpsVGb
